COPYRIGHT POLICY
SUMMARY: 16 Hoops LLC + Sand & Sky Real Estate Photography retain copyright ownership of all images and grants usage rights based on the purchased package. For the MLS package, temporary usage rights are provided until the property is no longer on the market. If further use is needed, permanent usage rights must be acquired. The Portfolio package grants permanent usage rights for all marketing purposes. The purchased images are non-transferable, and only the paying client is allowed to use them. Sand & Sky Real Estate Photography OR 16 Hoops LLC must be credited for the images used.

What do "temporary" usage rights mean?
"Temporary" usage rights refer to the most common type of rights granted for MLS listings.
As the realtor or agent who purchased the images, you are allowed to use the images until your property is sold or taken off the market. However, it is essential to give credit to Sand & Sky for the images when using them on your blog or in "Just Sold" marketing materials.
Once the property is sold, if you wish to continue using the images for your marketing purposes, you can contact the Front Office to purchase permanent usage rights. The amount you already paid for each photo will be deducted from your purchase, and you can buy usage rights for as many photos as you need.
Please refrain from distributing your images to anyone who has not obtained permission or made a separate payment to Sand & Sky.
What do "permanent" usage rights mean?
"Permanent" usage rights are part of our Portfolio package pricing.
This means that as the purchaser of the images, you have unrestricted and perpetual rights to use the images as you see fit. Whether it's for your website, a magazine ad, a billboard, a blog, or even on promotional products like coffee mugs, you have the freedom to use the images without limitations with permanent usage rights.
However, it's important to note that despite having these extensive usage rights, the copyright ownership and rights of the images still belong to 16 Hoops LLC + Sand & Sky Real Estate Photography, and you are not allowed to sell, transfer, or give away the images to anyone else.
Each client who acquires permanent usage rights is granted permission to utilize the photos solely for their marketing purposes.
What are the consequences of using copyrighted images without permission?
To safeguard the rights of 16 Hoops LLC + Sand & Sky Real Estate Photography, we employ a rights management system to monitor the internet for the unauthorized use of our images. If we discover that copyrighted images were used without proper authorization or payment, we take the following actions depending on the usage context:
We will request the user to promptly remove the images from their site or source within 24 hours.
The user will be asked to provide proper reference and credit to 16 Hoops LLC as the original photographer for each image.
Alternatively, the user will be offered the option to pay for permanent usage rights. This enables them to continue using the images indefinitely for all their marketing needs.
Copyright infringement is a serious matter, impacting our business. Anyone found using our images without permission or legitimate payment will be issued a Cease and Desist order.
If we identify any parties using our images without authorization or proper payment on platforms like NTREIS / MLS, we will promptly notify NTREIS, leading to the immediate removal of those images from MLS. Failure to comply may result in the issuance of a Cease and Desist order to the involved parties.
